nanonovaex provides spa appointment utilisation analytics systems and related software services designed for beauty and wellness businesses. Our platform offers real-time analytics, performance monitoring, business intelligence reporting, and integration capabilities to help spa operators optimise their operations and improve business performance.

User Obligations

As a user of our services, you agree to provide accurate and complete information when creating accounts or submitting forms, maintain the security of your login credentials, use our services only for lawful purposes and in accordance with these terms, not attempt to gain unauthorised access to our systems or other users' accounts, not interfere with or disrupt the operation of our services, and comply with all applicable laws and regulations in your use of our platform.

Intellectual Property

All content, features, and functionality of the nanonovaex platform, including but not limited to software, algorithms, user interfaces, designs, graphics, and documentation, are owned by nanonovaex AS and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use our services in accordance with these terms. You may not copy, modify, distribute, sell, or lease any part of our services without our express written permission.

Data and Privacy

Your use of our services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to the collection and use of your information as described in our Privacy Policy. You retain ownership of any data you input into our platform, whilst granting us the necessary rights to process and analyse this data to provide our analytics services.

Payment and Billing

Subscription fees are charged in advance on a monthly or annual basis as specified in your service agreement. All fees are non-refundable except as expressly stated in these terms or as required by applicable law. We reserve the right to modify our pricing with thirty days' notice to existing customers. Failure to pay fees when due may result in suspension or termination of your access to our services.

Service Availability

Whilst we strive to provide reliable and continuous service, we do not guarantee that our platform will be available at all times without interruption. We may perform maintenance, updates, or modifications that temporarily affect service availability. We are not liable for any damages resulting from service interruptions, provided we use reasonable efforts to minimise such disruptions.

Limitation of Liability

To the maximum extent permitted by applicable law, nanonovaex AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services. Our total liability for any claims related to our services shall not exceed the amount you have paid us in the twelve months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

Indemnification

You agree to indemnify, defend, and hold harmless nanonovaex AS and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Denmark, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Denmark. If you are a consumer residing in the European Union, you may also have rights under the laws of your country of residence.

Termination

Either party may terminate this agreement at any time with appropriate notice as specified in your service agreement. We may immediately suspend or terminate your access to our services if you breach these terms or engage in activities that may harm our platform or other users. Upon termination, you must cease all use of our services, and we may delete your account and data in accordance with our data retention policies.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated terms. If you do not agree to the modified terms, you must discontinue use of our services.

Severability

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable whilst preserving the original intent.
